Understanding Private Aviation vs. Commercial Flights

Many people use the term "airplane crash" broadly to cover both commercial and private flights. But the legal framework governing these incidents differs vastly depending on the type of flight. In the legal world, most private flights fall under the category of “general aviation.”

General aviation refers to all civil aviation operations, excluding scheduled commercial airlines and military flights. 

This includes:

• Personal and recreational flying - Individuals flying small, single-engine aircraft (like a Cessna 172) for leisure.
• Business and corporate jets - Private jets owned by companies to transport executives.
• Chater and on-demand flights - "Air taxis" or private charters that do not follow a set schedule.
• Instructional flying - Flight schools and student pilot training.
• Specialized services - Air ambulances, crop dusting, tours, aerial photography, and news gathering.

A Stark Contrast in Safety Statistics

The statistics for private and general aviation show a much higher level of risk than for commercial flights.

• Accident share: While commercial aviation remains ultra-safe, general aviation accounts for over 93% of all aviation accidents.
• Annual fatalities: Commercial airline fatalities in the U.S. often go years at or near zero; in contrast, general aviation typically sees over 300 deaths annually.
• Fatal accident rate: The fatal accident rate for general aviation is approximately 0.68-0.95 per 100,000 flight hours, which is significantly higher than the near-zero fatality rate of major commercial carriers.
• Safety oversight: Commercial flights benefit from massive redundant systems and mandatory two-pilot crews, whereas private flights are often single-pilot operations with fewer technical redundancies.
• Maintenance rigor: Commercial airlines are subject to continuous, strictly audited maintenance schedules, while private aircraft maintenance is often less frequent and follows less stringent safety oversight.

Why Private Crashes Are Harder to Litigate

Unlike commercial flights, which are governed by strict "common carrier" laws and require flight data recorders, private aviation presents unique legal hurdles:

• The “black-box” gap. Most small private planes are not required to have flight data or cockpit voice recorders, making accident reconstruction far more difficult.
• The 18-year shield (GARA). Under the General Aviation Revitalization Act of 1994, manufacturers are generally immune from product liability lawsuits if the aircraft or the part that failed is more than 18 years old.
• Lower training requirements. Private pilots often have significantly fewer flight hours and less experience in emergency maneuvers than commercial airline captains.
